35:30-24-1. Purpose

This section outlines the licensing needs and oversight of the Oklahoma Industrial Hemp Program, as outlined in the Oklahoma Agricultural Code, 2 O.S. § 3-401 and subsequent sections. The oversight and licensing of the Oklahoma Industrial Hemp Program will be managed by the Department, ensuring compliance with the Administrative Procedures Act, 75 O.S. § 250 and beyond; the Oklahoma Agricultural Code, 2 O.S. § 1-1 and further sections; and the procedural guidelines issued by the State Board of Agriculture within Title 35 of the Oklahoma Administrative Code.

35:30-24-2. Definitions
"Acceptable Hemp THC Level" indicates that when a laboratory tests a sample, it must report the amount of delta-9 tetrahydrocannabinol (THC) present in the sample, along with its uncertainty. The acceptable hemp THC level, as defined for meeting state hemp plan requirements, is achieved when the uncertainty of the reported THC content, measured on a dry weight basis, results in a range that encompasses 0.3% or less.

"Cannabis" refers to the plant, which, based on its THC content, is categorized as either "hemp" or "marijuana" Cannabis is a group of flowering plants in the Cannabaceae family, with Cannabis sativa being a species, and Cannabis indica and Cannabis ruderalis being subspecies. It encompasses all plant forms where the delta-9 tetrahydrocannabinol concentration on a dry weight basis has not been established.
