(4) Under the event that the Cannabis sativa L. plant or any portion of it meets all other requirements for industrial hemp as outlined under this section, with the exception that the dry weight basis concentration of delta-9 tetrahydrocannabinol (THC) is greater than 0.3 percent. This does not include treating the plant for destruction in accordance with this Part's departmental requirements.
(10) "Industrial hemp" refers to Cannabis sativa L. and any part of it, including the seeds, as well as any derivatives, extracts, acids, salts, isomers, and cannabinoids, whether or not they are growing, with a maximum dry weight concentration of 0.3 percent for delta-9 tetrahydrocannabinol (THC).
113–79. Plants of the Genus Cannabis that fit the R.S. 40:961 classification of "marijuana" are not allowed to be included in industrial hemp.
(A) Before any industrial hemp crops are harvested, the department must gather samples in order to analyze them and make sure the THC content is no more than 0.3 percent. Unless the department specifically authorizes in writing, the producer must harvest his approved industrial hemp plants no later than fifteen days after the date of sample collection.
(B) If the department has reason to believe a violation of this Part has occurred, in addition to any planned testing, the department may randomly check any industrial hemp crop or product and take a representative composite sample for field analysis. The department may detain, confiscate, destroy, or impose an embargo on an industrial hemp crop or industrial hemp product if the THC concentration in the crop reaches 0.3 percent on a dry weight basis.
