The 2018 Farm Bill has federally legalized the production of hemp. Under this bill, all cannabinoids and products stemming from hemp, including CBD, Delta-8, and Delta-9, among others, were legalized at the federal level.

But what about regulations at the state level? In 2019 Governor Brian Kemp signed House Bill 213, which legalized all the derivatives, extracts, cannabinoids, and also the isomers that can derive from hemp.

There is no concentration limit for the Delta-8 and CBD, but there is one for the Delta-9 THC. Hemp-derived Delta-9 concentrations in the products can only be about 0.3% or less on a dry weight basis.

The main purpose of this chapter is to:

1. Encourage the exploration into hemp cultivation and processing, opening new commercial markets for farmers and businesses through hemp product sales.
2. Investigate the expansion of the state’s hemp industry, which allows farmers and businesses to cultivate hemp products commercially.
3. It supports and empowers research on hemp cultivation as leaders in the hemp hemp installation industry. 

4. It aims to position the state and its citizens as the leaders in the hemp industry.
5. Also, balance the exploration of hemp cultivation and processing with public health, safety, and welfare concerns, addressing the potential for unwanted and unlawful uses of hemp’s chemical elements.
6. Enable the department, licenses, and universities to promote hemp cultivation, processing, and commercial hemp sale products.

"Federally defined THC level for hemp"means a delta-9-THC concentration of no more than 0.3 percent on a dry weight basis, or the THC concentration for hemp as defined in 7 U.S.C. Section 5940, whichever is greater.
